Veterans Disability Claims

Veterans Disability Claims – Easy-to-Understand Guide for Veterans

The VA disability claims process can feel overwhelming. Many veterans in Las Vegas, Henderson, and across Nevada worry about filing the right paperwork, gathering the right evidence, and understanding what the VA is asking for. At The Jacks Law Group, we make the process clear and straightforward. Led by VA Accredited Representative and 100% P&T disabled U.S. Army veteran Attorney David Jacks, we help veterans from all branches get the benefits they earned.

Initial Claims – Your First VA Disability Claim

An initial claim is the first time you ask the VA for disability benefits. This is where you tell the VA about the injuries or illnesses you got or worsened during your military service. You can file for one condition or many conditions at the same time. The VA will review your service records, medical records, and any other evidence you submit. The goal is to prove three things: you have a current disability, it started or worsened in service, and it is connected to your service.

We help you file your initial claim correctly the first time so you avoid common mistakes that lead to denials. We also make sure you include all your conditions so you do not have to file separate claims later.

Supplemental Claims – Adding New Evidence

A Supplemental Claim is one of the fastest ways to fix a denied or low-rated claim. You use this when you have new and relevant evidence that was not part of your original claim. Examples of new evidence include new medical records, a doctor's nexus letter, buddy statements from fellow service members, or lay statements from family members describing how your condition affects daily life.

This lane is often the quickest because the VA can review the new evidence and make a new decision without sending your file to the Board of Veterans' Appeals. We help you gather the strongest new evidence and file the Supplemental Claim correctly so you get a faster and better result.

Secondary Claims – Conditions Caused by Another Service-Connected Condition

Many veterans have conditions that are caused or made worse by a condition the VA has already approved. These are called secondary claims. For example, PTSD can cause or worsen sleep apnea, depression, or migraines. Knee injuries from service can cause back or hip problems later.

Secondary claims are governed by VA rules that allow you to get additional compensation for these related conditions. We review your service-connected conditions and help you file secondary claims so you receive the full rating you deserve.

Higher-Level Review Claims – Asking a Senior Rater to Look Again

A Higher-Level Review (HLR) is when you ask a more senior VA rater to review your claim without adding new evidence. This is a good option if you believe the original rater made a clear error in applying the law or the evidence. The senior rater can grant your claim, increase your rating, or send the claim back for more development.

HLR is usually faster than a Board appeal. We review your decision letter, identify any clear errors, and file the HLR for you so you have the best chance of a quick win.

Appeals to the Board of Veterans' Appeals (VA Judge)

If the other lanes do not work, you can appeal to the Board of Veterans' Appeals. This is where a Veterans Law Judge reviews your case. You can choose to have a hearing (in-person, virtual, or on the record) so the judge can hear directly from you. The Board has the power to grant your claim, increase your rating, or remand the case back to the VA for more work.

Board appeals can take longer, but they give you the chance to present your full story. We prepare you for the hearing, gather any additional evidence the judge may need, and represent you every step of the way.

All Other Types of Veterans Claims We Handle

We also help with:

  • Increase claims when your condition has gotten worse over time
  • TDIU (Total Disability based on Individual Unemployability) – 100% compensation even if your schedular rating is lower
  • PACT Act claims for toxic exposure and burn pit related conditions
  • Special Monthly Compensation (SMC) for especially severe disabilities
  • Non-service-connected pensions for wartime veterans who need financial help
  • Survivor benefits and Dependency and Indemnity Compensation (DIC) for families

No matter what type of claim or appeal you have, we make the process clear and fight for the maximum benefits you deserve.
